Overview

Welcome to MeltCup. The terms "we", "us" and "our" refer to MeltCup, the online store operated at meltcup.store. MeltCup operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). MeltCup is powered by Shopify, which enables us to provide the Services to you.

The following terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights.

By visiting, interacting with or using our Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree with these Terms or the Privacy Policy, you should not use or access our Services.

Nothing in these Terms limits or excludes any rights you have as a consumer under Spanish law, European Union law or the mandatory consumer protection laws of your country of residence.

Section 2 - Access and account

By agreeing to these Terms, you confirm that you are at least the age of majority in your country or region of residence, and that you have given consent for any minor dependants to use the Services on devices you own, purchase or manage.

To use the Services, including browsing our online store or purchasing any of our products, you may be asked to provide certain information, such as your email address and billing, payment and shipping details. You confirm that all information you provide is correct, current and complete.

You are solely responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell, assign or license your account to any other person.

Section 3 - Our products

We have made every effort to display our products as accurately as possible. However, colours and appearance may differ slightly from how they look on your screen depending on your device and its settings.

The MeltCup Candle Warming Mug uses a lit tea-light candle. Always follow the safety instructions included with the product: never leave a lit candle unattended, keep it away from children, pets and flammable materials, place the mug on a stable, heat-resistant surface, and allow it to cool before handling or cleaning.

Product descriptions may change at any time. We reserve the right to discontinue any product and to limit the quantities we offer to any person, region or jurisdiction.

Section 4 - Bundles, free gifts and digital content

Some offers include free gifts, such as a candle or a digital recipe book. Free gifts are included while stocks last, have no cash value, cannot be exchanged for money or other products, and may be shipped separately from the rest of your order.

Digital products (such as our recipe eBook) are delivered electronically by email or download link. By placing an order that includes digital content, you agree that delivery may begin immediately, and you acknowledge that, once the download has started, the right of withdrawal no longer applies to that digital content, as permitted by Article 103(m) of Spanish Royal Legislative Decree 1/2007.

If you return a bundle, the bundle discount and any free gifts are tied to the full bundle. Partial returns of a bundle will be refunded according to the price actually paid for each item as shown at checkout.

Section 5 - Orders

When you place an order, you are making an offer to purchase. We will send you an order confirmation by email. We reserve the right to refuse or cancel an order, for example in case of a pricing error, suspected fraud or lack of stock. If we cancel an order after payment, you will receive a full refund.

Please review your order carefully before submitting it. This does not affect your legal right of withdrawal described in our Refund Policy.

You confirm that your purchases are for personal or household use and not for commercial resale.

Section 6 - Prices and payment

All prices are shown in euros (EUR) and include VAT where applicable. Shipping costs, if any, are clearly shown at checkout before you pay. The price charged will be the one displayed at the time you place your order.

Prices, discounts and promotions may change without notice, but changes will never affect orders that have already been confirmed. Promotions may be subject to their own conditions; if there is a conflict between the terms of a promotion and these Terms, the promotion terms will prevail.

For orders shipped outside the European Union, the recipient may have to pay import duties, customs fees or local taxes charged by the destination country. These are not included in our prices.

You confirm that the payment information you provide is true and complete, and that you are authorised to use the payment method.

Section 7 - Shipping and delivery

We ship to the countries available at checkout. Delivery times shown on our website and at checkout are estimates. If no specific delivery date is agreed, we will deliver your order within a maximum of 30 days from order confirmation. If we fail to do so, you may ask us to deliver within an additional reasonable period and, if we still do not deliver, cancel the order and receive a full refund.

Free gifts and items from different warehouses may arrive in separate parcels. The risk of loss or damage passes to you when you (or a person designated by you) receive the products. For more details, see our Shipping Policy.

Section 8 - Returns, right of withdrawal and legal guarantee

If you are a consumer in the European Union, you have the right to withdraw from your purchase within 14 days of receiving it, without giving any reason. Our commercial policy extends this period to 30 days. Full details are in our Refund Policy.

All physical products are covered by the legal guarantee of conformity of 3 years under Spanish law. If a product is defective or not as described, contact us and we will repair, replace or refund it as required by law. This guarantee is independent of our Refund Policy.

Section 9 - Intellectual property

All content on our website, including texts, images, graphics, logos, product reviews, videos and their design and arrangement, belongs to MeltCup or its licensors and is protected by intellectual property laws. You may use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify or publish any material from the Services without our prior written consent.

Shopify's name, logo and related marks are trademarks of Shopify. All other names and logos are the property of their respective owners.

Section 10 - Third-party tools and links

The Services may include tools, apps or links provided by third parties over which we have no control. We are not responsible for the content, accuracy or practices of third-party websites or services. Your use of them is at your own risk and subject to their own terms.

Section 11 - Relationship with Shopify

MeltCup is powered by Shopify. However, any purchase you make in our store is made directly with MeltCup. Shopify is not responsible for any aspect of the sale between you and MeltCup.

Section 12 - Privacy

All personal information we collect through the Services is handled in accordance with our Privacy Policy and the EU General Data Protection Regulation (GDPR). Because the Services are hosted by Shopify, Shopify also collects and processes certain personal information in order to provide the Services.

Section 13 - Reviews and feedback

If you submit reviews, comments, photos, videos or other content ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish and display that Feedback in connection with the Services and our marketing. You confirm that you own the rights to your Feedback and that it is truthful and does not infringe the rights of any third party. We may remove Feedback that is unlawful, offensive or otherwise violates these Terms.

Section 14 - Errors and omissions

Occasionally, information on our website may contain typographical errors or inaccuracies relating to product descriptions, prices, promotions, shipping charges or availability. We reserve the right to correct such errors. If an obvious pricing error affects your order, we will contact you before shipping and give you the option to confirm the order at the correct price or cancel it for a full refund.

Section 15 - Prohibited uses

You may use the Services only for lawful purposes. You may not use the Services to break any law, infringe intellectual property rights, harass others, transmit false or misleading information, send spam, impersonate any person, upload viruses or malicious code, scrape or copy the Services by automated means, or interfere with the security of the Services. We may suspend or close your account if you breach these Terms.

Section 16 - Disclaimer and limitation of liability

We do not guarantee that the website will always be available, uninterrupted or error-free. To the maximum extent permitted by law, MeltCup will not be liable for indirect or consequential damages arising from the use of the Services.

This limitation does not apply to liability for wilful misconduct or gross negligence, death or personal injury caused by negligence, the legal guarantee of conformity, or any other liability that cannot be limited or excluded under applicable law.

Section 17 - Severability and entire agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right or provision does not constitute a waiver of that right. These Terms and the policies published on this website constitute the entire agreement between you and us regarding the Services.

Section 18 - Changes to these Terms

We may update these Terms from time to time by publishing a new version on this page. The version in force at the time you place your order will apply to that order.

Section 19 - Governing law and disputes

These Terms are governed by Spanish law. If you are a consumer resident in the European Union, you also benefit from the mandatory consumer protection provisions of your country of residence, and you may bring a claim before the courts of your place of residence.
